A grim medical claim from an attorney for a man charged with raping two women in Massachusetts 34 years ago. Stephen Paul Gale's attorney, Sammy Weiss, said every time he sees Gale, he looks worse and worse. "I am hoping they give him the proper treatment and get his health in shape," Weiss said. "We have no case if he is not alive, and we have to get him back in shape here."Gale is charged with raping two women who were working at a Framingham clothing store in 1989. The survivors pushed for their case to be reopened, and Gale was indicted in May after investigators say DNA linked him to the crime. Gale was tracked to a yacht in Los Angeles in August after a nationwide manhunt. He was arrested after leading L.A. police on an hour-and-a-half-long chase. The arrest was in connection with the Massachusetts warrant, but Gale also had an open fraud case from the 1990s out of L.A. The Los Angeles District Attorney's Office is moving forward with prosecuting the old fraud case before Gale can be extradited to Massachusetts. Outside court, Weiss commented on Gale's charges in the 1989 rape case in Massachusetts. "I have investigated it. It is old. It is a tattered case that was brought up 35 years later. We don't know how the DNA was handled," he said. "It's not so black and white just because Boston says they have a good case. You can say a lot of things. You've got to prove it. One of the survivors responded to Gale's attorney, telling 5 Investigates: "He is right. It does need to be proved. Bring your client to Massachusetts so we can move forward and prove our case with DNA evidence and victims who can positively identify him.""We have his DNA. Concrete evidence and two eyewitnesses who can tell you it’s him. We are so grateful that he was caught by Los Angeles PD, but the only reason he was apprehended was because we were chasing him," the second survivor told 5 Investigates. Gale is due back in court next month.
